<p>Last week, a customer brought a Mercedes in to East Main Auto in Northborough. It had a problem with its transmission. East Main specializes in Mercedes repair, but owner Kenny Giles was forced to bring the car to a Mercedes dealership to buy the appropriate part.<br />
&#8220;Mercedes wouldn&#8217;t release the part, because we&#8217;re not a Mercedes dealership,&#8221; said Giles.<br />
It took the mechanic an extra day to fix the car, and probably cost a little bit more money.<br />
It happens a lot with new cars. Independent dealerships aren&#8217;t given the software, diagnostic tools or parts needed to fix certain cars so owners are forced to return to the dealership for repair.<br />
This week, Secretary of State William Galvin gave the OK to the House Clerk to proceed with Right to Repair initiative, a question proposed for the 2012 election ballot. The initiative is one of four that Galvin certified has enough signatures (more than 68,911) from registered voters to proceed, according to The Boston Herald.<br />
The Right to Repair legislation, according to Massachusetts Right to Repair, &#8220;would give every technician—not just dealers—access to the same information, so you can get your car fixed where you want to, saving $300-$500.&#8221; As it stands, say advocates for the new leglsation, certain diagnostic equipment, information and tools are reserved for the manufacturer of the car, forcing the car owner to go to the dealer, rather than his or her chosen mechanic, when there is a problem.<br />
Giles said the laws, as they stand, vary according to the maker, but in most circumstances, much of the software needed to diagnose a problem in a new car isn&#8217;t available to independent car repair shops until at least 12 months after the car is on the market. He fears that the time may even increase, and supports the Right to Repair initiative.<br />
&#8220;They already do it, and they are trying to make it so it will be worse,&#8221; said Giles. &#8220;What will happen is if the dealerships are allowed to service certain systems, it&#8217;s a free market for them. It&#8217;s like telling a coffeeshop that you&#8217;re going up 62 percent on coffee beans, but the shop can&#8217;t go up on the price of coffee. If you look at the independent shops, [the initiative] is saying to let us do the most we can do. We&#8217;ve been blocked before, and nobody talks about it. Volvo is a huge manufacturer that has blocked software, and you have to get around it.&#8221;<br />
The Legislature, acccording to The Boston Herald, has until May 2 to vote on the petition. If not approved by the lawmakers, 11,000 additional signatures must be gathered before the measure makes it to the November ballot.<br />
Giles has been a mechanic since he got out of high school, and has owned East Main for 21 years. No longer can mechanics drive around the block and try to figure out what&#8217;s making that knocking noise. Even something as simple as fixing a window that won&#8217;t go up requires software to pinpoint, and control, the repair. The airbags, seatbelts, steering, tire pressure and hundreds of other mechanisms that can cause car problems can now be diagnosed on a laptop, which gives mechanics codes on where to look, and how to fix it.<br />
&#8220;When I started, we had books,&#8221; said Giles. &#8220;Now, I can hook up a laptop to a certain car and put the windows up and down and turn the lights on and off with it, as long as I have the software. You are forced to keep up with this or you won&#8217;t keep your business.&#8221;<br />
A study conducted by cartalk.com found, after reviewing charges on Honda and Dodge dealerships verses independent repair shops, customers paid an average of of up to $320 more.<br />
&#8220;I used to work for a dealership,&#8221; said Giles, &#8220;and I knew the pricing and kept track of everthing. I couldn&#8217;t believe some of the things that people got charged for.<br />
Some argue that dealerships might do a better job with the car since it specializes in the make. Still, proponents of the Right to Repair initiative say it should be up to the consumers to decide that for themselves.<br />
The software to keep up with diagnostics for the latest cars, too, is expensive. Giles estimates that he&#8217;s easily spent $25,000 in software and computer upgrades. It is necessary; in one day, more than half the cars in the lot at East Main Auto came in with &#8220;check engine&#8221; lights on. The shops that didn&#8217;t, or couldn&#8217;t, keep up, were weeded out, unable to keep up with competitors who updated electronics.<br />
And Giles just hopes he can stay in business.<br />
&#8220;I think it&#8217;s foolish in this day and age, with the recession, that we&#8217;re talking and worrying about this,&#8221; said Giles. &#8220;Anything that can slowly kill a business will hurt the economy. There are six families that live off of this business. We&#8217;re employing six people to keep six families off of employment.&#8221;</p>

<p>Boston, MA – The Right to Repair Coalition announced today that its ballot initiative will be on the 2012 ballot, having received the official letter this week from the Secretary of State’s office confirming that 83,180 signatures have been approved from every region of the state, far more than the 68,000 signatures required.  The measure is now transmitted to the legislature and they have until May to approve it, bringing relief to consumers facing high dealership repair bills even sooner.</p>
<p>If the legislature does not act, 11,485 additional signatures will be gathered and it will appear on the 2012 statewide ballot.</p>
<p>When Right to Repair is passed, the new law will save motoring consumers money by requiring the car companies to provide all non-proprietary repair information to vehicle owners or their preferred technicians. The car companies provide full repair information to their new car dealerships, but relatively little to the independents or to the owners of the vehicles.</p>
<p>“We are thrilled that this consumer legislation is now officially on the 2012 ballot,” said Art Kinsman of the Massachusetts Right to Repair Coalition. “For the first time, consumers will actually have options when it comes to car repairs, and those options will be more affordable,” he added. </p>
<p>“It’s time to level the playing field and keep the big automobile manufacturers and their dealerships from dictating where consumers go for car repairs,” said Kinsman.  </p>
<p>Currently, auto manufacturers provide only some of the diagnostic and safety information needed to repair vehicle owners’ cars with independent technicians, limiting consumers’ choices and losing business for neighborhood repair shops.</p>

<p>BOSTON&#8211;(BUSINESS WIRE)&#8211;The Right to Repair Coalition announced today that the group’s consumer voter initiative will advance toward the 2012 ballot, having collected 80,000certified signatures to be delivered to the Secretary of State’s office in advance of tomorrow’s December 7th deadline, far more than the 68,000 required.</p>
<p>“For too long, the big automobile manufacturers and their dealerships have dictated where you get your car repaired”<br />
When passed, the new law will require carmakers to provide all non-proprietary repair information to consumers or technicians through a device that can access the same information that manufacturers now provide to their own dealers but often not to independent technicians.</p>
<p>“This strong, pro-motoring-consumer language makes it easier and more cost-effective for motorists to get their cars repaired where they want, especially important during tough economic times,” said Art Kinsman of the Massachusetts Right to Repair Coalition. “For the first time, consumers in Massachusetts will have a full range of affordable options when it comes to car repairs,” he added.</p>
<p>“After the ballot question wins in 2012, and the law goes into effect a few years later, when the dreaded “Check Engine” light comes on, every consumer and the neighborhood technician of their choice will be able to obtain repair information they can’t currently get,” he added.</p>

<p>STATE HOUSE, BOSTON, NOV. 30, 2011…..Massachusetts voters may be asked next year to settle policy standoffs over legalizing marijuana for chronically ill and suffering patients, permitting certain terminally ill residents to self-administer life-ending medication and forcing auto dealers to send diagnostic information to repair shops, according to campaign organizers who say they&#8217;ve gathered enough signatures to advance their proposals closer to the ballot in 2012.</p>
<p>Ballot campaigns were required to file 68,911 valid signatures with city and town clerks by last week, the toughest, most expensive hurdle to placing a policy question before voters. Activists need to bring those signatures to Secretary of State William Galvin&#8217;s office by next week for final certification. A successful signature drive opens a six-month window for state lawmakers to support their own versions of any of the proposals if they wish to prevent them from moving toward the ballot.</p>
<p>Advocates for these proposals, as well as a plan to attach consequences to teacher evaluations and eliminate seniority as a factor in teacher hiring and placement decisions, say they hope a successful collection of signatures will influence lawmakers to act favorably on their preferred policies, avoiding expensive, divisive and often unsuccessful ballot box fights.</p>
<p>&#8220;At this point, we would prefer that the Legislature take this up and pass it. We still think it&#8217;s a good vote for them, for their constituents,&#8221; said Art Kinsman, spokesman for the car repair question. &#8220;We are prepared to go all the way with the ballot if necessary, but I really think the best solution is always that the Legislature takes a vote.&#8221;</p>
<p>&#8220;We&#8217;re fully ready to go to the ballot and we&#8217;re always open to working with the Legislature and lawmakers to address it through the legislative route,&#8221; said Sam Holdren, communications director for Stand for Children, sponsor of the proposal concerning teachers. &#8220;It&#8217;s something that we&#8217;re still pursuing and still discussing.&#8221;</p>
<p>Already this year, two ballot campaigns &#8211; one to permit more food stores to sell beer and wine, another to bar auto insurers from basing premium rates on customers&#8217; credit scores &#8211; were called off after lawmakers brokered compromises proposals.</p>
<p>A proposal to add a 5-cent deposit to the cost of beverage bottles that may be redeemed upon recycling was also called off when backers suggested they had the votes in the Legislature to pass the plan this session. Legislative leaders have given no indication that the plan is on their upcoming agenda.</p>
<p>Should lawmakers opt to allow the proposals to head to the ballot, supporters would be required to collect another 11,500 signatures, clearing the way for their proposals to come before voters. The last time voters were asked to resolve more than three policy questions in one election cycle was in 2000, when an income tax cut was one of eight policy questions on the ballot.</p>
<p>Equally of note is a proposal derailed by the signature requirement: a plan to repeal the mandate that all Massachusetts residents obtain health insurance. That requirement is a cornerstone of a 2006 law signed by Gov. Mitt Romney intended to provide near-universal access to health insurance. The law also served as a model for a 2010 federal law signed by President Barack Obama that has been attacked by Republicans as costly and disruptive.</p>
<p>The ballot question to repeal the individual mandate failed to collect enough signatures, according to campaign treasurer Bridget Fay, who works with Massachusetts Citizens for Life. Fay said Citizens for Life will turn its attention to defeating the so-called Death With Dignity ballot proposal. She said she&#8217;s spoken with &#8220;a few state legislators&#8221; who she said may introduce legislation to repeal the individual mandate or ban penalties for residents who obtain insurance that doesn&#8217;t meet existing coverage requirements.</p>
<p>Fay said supporters of this year&#8217;s question are eyeing 2014 as a chance to renew their effort.</p>
<p>&#8220;We did get some heavy national interest, but it was about a week before signatures were due,&#8221; she said.</p>
<p>Supporters of the &#8220;Death with Dignity&#8221; question say permitting terminally ill and suffering patients &#8211; with no other medical recourse &#8211; to end their lives is humane and can save patients and families months of anguish. Opponents argue that it is error-prone and lacks safeguards.</p>
<p>Proponents of the medical marijuana question say it, too, is a human course of treatment for cancer patients or those suffering from debilitating and chronic diseases. Opponents say it could result in greater availability of illegally sold marijuana, could cause crime and might subject Massachusetts to federal prosecution.</p>
<p>Backers of the auto repair question say auto manufacturers routinely withhold key diagnostic repair information for increasingly complex and computerized vehicles, forcing consumers to go directly to the manufacturers for repairs. But auto manufacturers counter that the proposal is a ploy by aftermarket auto parts dealers to produce cheap replicas of car parts.</p>
<p>Supporters of the teacher evaluation questions say they will attach consequences for teachers who fail to demonstrate their students are improving and will deemphasize seniority as a factor in hiring, layoff and placement decisions, guaranteeing that high-quality teachers will be rewarded. But opponents, including the Massachusetts Teachers Association, say teacher evaluation criteria were approved by a state board a few months ago and should be tested without sharp consequences first to ensure they are reliable.</p>
<p>Advocates for a ballot question to limit the annual increase in water and sewer rates did not respond to a request for comment. Proposals to sanction three casinos for Massachusetts, to forbid no-bid energy contracts and to force voters to present identification at the polls were scratched in August when Attorney General Martha Coakley determined they failed to meet the legal criteria to advance.</p>

<h2>A &#8220;right to repair&#8221; ballot initiative related to car repairs by independent auto mechanics has gathered the required number of signatures to move to the next step in the process, according to a group supporting the effort. Yesterday was the deadline to submit at least 68,911 signatures to move measures toward getting on the ballot in 2012. Secretary of State William F. Galvin must certify or reject the petitions next month. If he OK&#8217;s the petitions, they would go to the Legislature, where lawmakers could enact the measures. If they don&#8217;t, petitioners would need to gather another 11,500 signatures by July to put their questions on the ballot. Art Kinsman, spokesman for the Massachusetts Right to Repair Coalition, said it collected more than 106,000 signatures, just to be safe. The group was unable to get a measure through the Legislature last year. It wants the state to require auto manufacturers to provide independent mechanics access to diagnostic information now available only to dealerships. Consumer advocates have supported the bill, saying more access would drive down costs. Opponents say it would give away trade secrets. This time, Kinsman said, &#8220;We like our chances for this to go to the ballot.&#8221; Galvin said about a quarter of the ballot initiatives submitted now appear on track to move forward, though it is too soon to say how many will appear on next year&#8217;s ballot. In addition to the right-to-repair petition, Galvin said signatures were submitted for initiatives that would allow physician-assisted suicide and medical use of marijuana. A campaign to repeal the &#8220;individual mandate,&#8221; the part of the state&#8217;s 2006 health care law, which requires all residents to buy medical insurance or pay a penalty, failed to gather enough signatures to move forward. Anne Fox, one of the campaign&#8217;s organizers and president of Massachusetts Citizens for Life, said volunteers collected about 50,000 signatures from registered voters. Fox said many activists who might have otherwise worked on the petition drive were busy working to defeat another petition to legalize doctor-assisted suicide. Fox said opponents of the state&#8217;s individual mandate, which is considered a model for a similar provision in the federal health care law passed last year, will stay in touch with those who signed their petition. They may eventually try to repeal the mandate through legislation or launch another ballot campaign, she said. &#8220;We don&#8217;t want the effort to drop,&#8221; Fox said.
